These terms
These terms are between you and RealAC. Where they say “we” and “us”, that is RealAC, and “you” is the person or organisation that buys or uses a RealAC licence. They apply from the moment you install the plugin or activate a licence, whichever happens first, and they apply to a trial exactly as they apply to a paid licence.
If you accept these terms for a company, a network or any other organisation, you confirm that you have the authority to bind it, and “you” means that organisation.
You have to be old enough to enter a binding contract where you live, and at least 16 years old. We may ask you to show that you are, and we may suspend a licence while we wait.
What is being sold
Access to a service, not a perpetual licence to software. The plugin is a client for that service and is inert without it: an unlicensed copy runs nothing.
We develop RealAC continuously. What it covers, how it behaves and how it is delivered change without notice, and the behaviour of the service on any particular day is not part of what you bought. We may add, change, withdraw or replace any part of it.
Licence scope
One licence covers one customer. It carries a concurrent player cap and a concurrent instance cap, both set by the plan you bought and listed on the pricing page. Both caps are enforced by suspending protection, not by breaking your server.
A licence is personal to you and is not transferable. You may not resell it, sublicense it, hand it to another organisation, or run it for servers you do not operate. A licence issued to you stays your responsibility, including when somebody else uses it and including when they do so without your knowledge.
We own RealAC. Nothing in these terms moves any intellectual property in the plugin, the service, the models, or anything we derive from either.
Term and renewal
A plan runs for 30 days from activation.
At checkout you choose how it continues. A subscription renews every 30 days until you cancel it; a one-off plan runs its 30 days and ends. You can switch between the two, and you can cancel a subscription at any time before the next renewal, in which case the plan runs out the period you have already paid for.
We may change our prices at any time. A price change never applies to a period you have already paid for.
Prices and tax
Prices are shown in euros and exclude tax. Any tax that applies where you are is added at checkout, so the total shown before you pay is what you pay.
Any duty, conversion cost or bank charge your own jurisdiction or your own payment provider adds on top of that is yours.
Acceptable use
The following are not permitted, whether you do them yourself or help somebody else do them:
- Redistributing, reselling, sublicensing, renting, lending or publishing the plugin or any part of it.
- Sharing a licence key, an installation or a set of credentials across organisations, or using one licence for servers you do not operate.
- Decompiling, disassembling, deobfuscating, reverse engineering, or otherwise attempting to recover the source, the logic or the internals of the plugin or the service.
- Circumventing, disabling, patching or interfering with licensing, activation, integrity or update mechanisms, or running a modified build of the plugin.
- Probing, scanning, load testing or attempting to gain unauthorised access to our service, our infrastructure or another customer’s data.
- Using RealAC, or anything you learn from running it, to build, test, tune, document or promote a cheat, a bypass, or any tool meant to evade cheat detection.
- Sending us telemetry you have manufactured, altered or replayed.
- Using the service to harass, defame or discriminate against anybody, or for anything unlawful.
- Giving us false information about yourself, your organisation, your servers or your payment method, or leaving information uncorrected once it has changed.
Data, and the rights you grant us
RealAC works by receiving information from your server and analysing it. The privacy page describes what we receive. This section is about what we may do with it.
What it covers
“Telemetry” means everything the plugin sends us from a server running your licence: gameplay, session and connection information, what RealAC raised, the punishments that followed, the reports your staff send us, and information about the licence and the installation itself. Telemetry is about your players as well as about you.
The rights you grant
You grant us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, transferable and sublicensable right to store, reproduce, process, analyse and create derived works from the telemetry, for:
- delivering detection to you;
- delivering detection to every other customer;
- operating, securing, supporting and debugging the service;
- building, training, evaluating, calibrating and improving the models and the checks that make RealAC work, including ones that do not exist yet;
- producing aggregate and statistical information about how cheating behaves, which we may publish;
- enforcing these terms, and defending ourselves if we have to.
What we derive is ours
Models, parameters, scores, labels, statistics, aggregates and anything else we derive from telemetry belong to us exclusively. They are not your data. They are not returned, restricted, licensed to you or destroyed when your licence ends.
You confirm you can grant it
Telemetry is largely about people who bought nothing from us and have never heard of us. You confirm that you are entitled to send it to us and to grant the rights in this section, that you have told the people on your server that an anticheat is running and processes information about how they play, and that you hold whatever permission or lawful basis your own law requires. See Your obligations.
It does not end when the licence ends
The rights in this section survive expiry, cancellation, suspension and termination, however those happen and whoever causes them. They also survive a refund.
Some of it cannot be undone
A detection model is built from very large volumes of gameplay and cannot be un-built from any one part of it. The same is true of an aggregate statistic. Where we remove records about a player we remove the records; we do not rebuild, retrain or unwind anything already derived from them, and nothing in these terms obliges us to.
Nothing is owed for it
You are not owed payment, credit, attribution or a share of anything for the telemetry or for what we derive from it.
What we will not do with it
We do not sell telemetry, and we do not hand it to advertisers or data brokers. We do not give another customer access to what your server sends, and we do not publish anything that identifies an individual player. What travels between customers is the improvement, not the data.
Your obligations
Telling your players. You are responsible for telling the people who play on your server that an anticheat is running and that it processes information about how they play. The privacy page is written so you can link it or paste from it.
Your role and ours. You choose to run RealAC on your server, and you set the rules it acts under. Under European and UK data protection law that makes you the controller for what your server sends us, and us a processor acting for you when we deliver detection to you. We are a controller in our own right when we use telemetry to operate, secure and improve RealAC.
Data processing agreement. European law normally expects a written agreement for the processor half of that relationship. Ask us in Discord and we will put one in place.
Your staff. What your staff do with what RealAC tells them is your decision and your responsibility, including whether a punishment follows and whether it was fair.
Your configuration. The punishment commands RealAC runs on your server are the ones you configured. Keeping your licence key secret, choosing who gets staff permissions, and keeping your server otherwise lawful are all yours.
Availability
We do not offer a service level agreement. We do our best, and if our service is unreachable your server keeps running exactly as it would without the plugin installed. It does not block logins, it does not hold up your server, and it does not act on stale information. Protection resumes on its own when the connection returns.
There is no uptime commitment, no status page and no credit for an outage. Maintenance happens when it needs to.
Suspension and termination
We may suspend or terminate a licence, an installation, or your access to the service, at any time and with immediate effect, if:
- you breach these terms, or we reasonably believe you have;
- we have evidence of tampering with the plugin or the service, of an attempt at circumvention, of an attempt to recover our internals, or of a key used outside the organisation it was issued to;
- you are involved in building, selling, promoting or using cheats or bypasses, or you help somebody who is, or you give us good reason to believe it;
- a payment fails, is reversed, or is disputed with your payment provider;
- you give us false information, or leave information uncorrected once it has changed;
- the law requires it, or we reasonably believe that continuing would expose us to legal risk or would put the security of our service or another customer at risk.
We judge whether the evidence is good enough, on the balance of what we have. We do not have to warn you first, we do not have to say which of the reasons above applies, and we do not have to explain how we know. Nothing in this section obliges us to disclose anything about how RealAC reaches a conclusion, to you or to anybody else.
There is no refund under this section, and no credit for the remainder of the period. See refunds.
Working around a suspension is a separate breach, including buying again under another name, another organisation or another payment method.
You can stop using RealAC whenever you like by removing the plugin. When a licence ends, for any reason, protection stops and nothing on your server breaks. The sections that by their nature should continue do continue, including Data, and the rights you grant us, Liability, Indemnity and Governing law.
Refunds and chargebacks
Our refund policy is part of these terms.
A chargeback is not a refund and is not how to ask for one. If you raise a chargeback or a payment reversal instead of talking to us, your licence terminates immediately, you owe us the amount reversed together with whatever fee our payment provider charges us for the dispute, and we may recover both. We may also decline to sell to you again.
What we do not promise
No anticheat catches everything, and we do not claim to. RealAC is a tool that gives your staff evidence and, where you configure it to, acts on that evidence. The decisions on your server remain yours.
Detection is not exact. RealAC can miss a cheater, and it can raise something about a player who was not cheating. Every anticheat has both properties, and nobody has built one that has neither.
The service is provided as it is and as it is available, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment or non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error free, or that it will meet your requirements. Where your law does not allow a warranty to be excluded, the exclusion applies as far as that law allows and no further.
Liability
Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, and for fraud.
Subject to that, and to the fullest extent the law allows:
- We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profit, lost revenue, lost players, lost goodwill, lost data or business interruption, even if we were told they were possible.
- We are not liable for anything that happens on your server: a punishment applied to a player, a player who leaves, a dispute with a player, a payment you make to a player, or anything your staff do with what RealAC tells them.
- We are not liable for undetected cheating on your server, or for what it cost you.
- We are not liable for another plugin, another anticheat, your host, your hardware or your network, or for a conflict between RealAC and any of them.
- Our total liability to you, for everything, in aggregate, is capped at what you actually paid us in the 12 months before the event the claim arises from. If you have paid us nothing, including on a trial, our total liability is nothing.
Indemnity
You will defend us and cover our losses, including reasonable legal costs, against any claim brought against us arising from your use of RealAC, your breach of these terms, a punishment applied on your server, a claim by one of your players or by a data protection authority about information your server sent us, or your breach of a law that applies to you.
We will tell you about a claim we want covered, and you may take over defending it, as long as you do not settle it in a way that admits something on our behalf or costs us anything without our agreement.
Changes to these terms
We may change these terms. A change is posted on this page and dated, and takes effect when it is posted, except that a change which materially reduces what you get takes effect for you at your next renewal.
Where we can, we will say so in our Discord as well. Continuing to use RealAC after a change takes effect is acceptance of it. If you do not accept a change, stop using RealAC; that is your remedy, and it does not entitle you to a refund for a period you have paid for.
Governing law
These terms are governed by the law of the place where RealAC is established, and the courts there have jurisdiction.
If you are a consumer rather than a business, a choice of law cannot take away protections your own country’s law gives you, including the withdrawal right described on the refunds page.
A claim under these terms has to be brought within 12 months of the event it relates to, as far as your law allows a period to be agreed.
General
Entire agreement. These terms, the privacy page and the refunds page are the whole agreement between us about RealAC. They replace anything said before, including anything said in Discord.
Severability. If part of these terms turns out to be unenforceable, the rest still applies, and that part applies as far as it can.
No waiver. If we do not enforce something straight away, we have not given it up.
Assignment. You may not transfer these terms or your licence to anybody. We may transfer them, for instance if the business is sold, and the rights in Data, and the rights you grant us transfer with them.
No third-party rights. Nobody other than you and us can enforce these terms. Your players are not a party to them.
Support. We help customers in Discord because we want to, not because these terms oblige us to. There is no support commitment and no response time.
Feedback. If you send us an idea, a bug report or a suggestion, we may use it without owing you anything.
Events outside our control. We are not liable for a failure caused by something outside our reasonable control.
Headings. Headings help you find things. They do not change what a section means.
